On Friday the 17th, the House Judiciary Committee heard both HB100, the 14-day waiting period bill, and HB101, the ban on the sale of semiautomatic rifles and registration of currently owned ones. HB100 was passed out of the committee on a party-line vote of 6-4, it now heads to the House Floor. There was a second committee substitute for HB101, after the first one in House Consumer and Public Affairs. Public testimony was heard on the bill, but it wasn’t voted on at Friday’s meeting – so it is still in the House Judiciary Committee. The new version has yet to be made available to the public.

On the Senate side, SB44, the ban of carrying firearms within 100ft of a polling place, both open and concealed, passed the Senate floor on a 28-9 vote. Two Republicans joined all Democrats present in voting for the bill. Here is how your State Senator voted (or did not vote). The bill now heads to the House Government, Elections & Indian Affairs Committee.

Right before the filing deadline, two more anti-gun bills were filed. SB427 is another version of a 14 day waiting period. The bill has the same aim, but it uses different language to accomplish it. Also, SB428, a bill targeting firearm retailers and manufacturers was filed. The bill is an attempt to circumvent the Federal Protection of Lawful Commerce in Arms Act through New Mexico’s Unfair Practices Act. The bill would try make it easier to sue a firearm manufacturer or retailer in New Mexico. Both bills are in the Senate Health and Public Affairs Committee.

We are now more than halfway through with the session, if you have followed sessions before, you know that the pace and intensity picks up significantly in the second half. Right now, there are no anti-gun bills scheduled for committee hearings, but that can change very quickly and several bills could be heard this week. We encourage you to contact committees and your legislators today to ask them to oppose bad bills.

HB 100 – 14 Day Waiting Period  to purchase a firearm!!!!!

On Friday, February 17th, the House Judiciary Committee will be hearing both HB100 and HB101. HB100 would impose a 14 day waiting period for all firearm sales. HB101, would ban the sale of semiautomatic rifles, and .50 caliber rifles and ammunition. Currentl owners of .50 caliber and semiautomatic rifles would have to register them with the state of New Mexico or face criminal charges. The meeting will be held in Room 309 at 1:30pmor

New Mexico Wildlife Monthly Update

This year the department will be presenting the “Drawing Your Path to Success” video and podcast series throughout the draw, in addition to special editions of the New Mexico Wildlife Monthly Update featuring hunt forecasts for the 2023-2024 season. The video and podcast series will start with an overview of how the draw works and things to consider for success. We will then feature pre-draw hunt forecasts, by species (deer, elk, bighorn, Barbary sheep, etc.), presented by wildlife managers to help you choose when and where to apply. Each episode will be in question and answer format and will be indexed to help you quickly find the answers you need. Have a question you want our experts to answer? We will ask for your questions on our social media pages the week prior to each episode.

Also known as gemsbok, South African oryx are a visually striking, large African antelope with distinct markings and long, straight horns grown by both sexes. Males typically have horns that are heavier and have larger bases, while the females typically have longer, thinner horns with smaller bases.

2023-2024 Barbary Sheep Hunting Forecast

Barbary sheep, also known as aoudad, is one of three exotic big-game species hunted in New Mexico. Originally native to North Africa, Barbary sheep were first introduced to New Mexico in the 1940s by a private ranch in the southeastern part of the state. They were officially released in the 1950s in the Canadian River drainage near the Las Vegas Plateau. Since their release, there has been a rise in the popularity of hunting Barbary sheep in New Mexico, with licenses increasing to more than 1,000 annually.

The three bills we are watching that were supposed to be heard in committees yesterday and today were all “rolled over.” This means that no vote was taken by the committees on the bills, but they may be brought up for a vote in future committee meetings.

In the House Judiciary Committee, HB72, the ban on “semiautomatic firearm converters” was rolled over again – that was the second time this has happed to this bill in the House Judiciary Committee. As we expected, a new committee substitute was brought forward by the sponsors. But the bill is still a mess and it is unclear what it would actually ban. When the “expert witnesses” for the bill were asked if the new bill would ban possession of bump stocks, they replied that they did not know. A third version of the bill may be introduced in a future meeting, we will let you know if and when that happens.

In the House Consumer and Public Affairs Committee, both HB224 and HB238 were held back by the sponsors and were not discussed in the meeting. Both bills would create a crime of discharging firearms in “densely populated areas,” with no exceptions for self-defense or indoor shooting ranges. Nor do the bills define what a “densely populated area” is. We may see a new version of one or both of the bills at a future committee meeting.

Currently, most of the bills we are watching are in the House Judiciary Committee or the Senate Judiciary Committee. We will send updates when they are scheduled for a vote. We have a new pre-drafted letter opposing HB101 to reflect the changes made in the committee substitute.

Today on the House Floor, HB9, the gun owner liability bill, passed by a vote of 37-32. Seven Democrats joined all Republicans in voting against it. The bill was amended several times, we will review the amendments when they are published. HB9 now heads over to the senate side. We expect the first stop for the bill to be the Senate Health and Public Affairs Committee, but we will send updates as we receive them. You can see how all members of the house voted at this link.

The committee substitute for HB101 was made available to the public today. The new bill outlaws the sale of new semiautomatic rifles and some semiautomatic pistols. Current owners would be allowed to keep their firearms if they register them with the state. The bill also bans .50 Caliber rifles and cartridges. The next stop for the bill is the House Judiciary Committee.

Today in the House Consumer and Public Affairs Committee, the full-blown attack on our right to keep and bear arms was on open display. First, HB50, the magazine ban, was “rolled over”  and not heard with the consent of the sponsor who then endorsed HB101. This means HB50 could come back, but HB101 is likely the priority bill we must oppose.

HB100, the 14 day waiting period was passed on a party-line vote. Representative John Block proposed an amendment to the bill to allow someone who has filed for a restraining order against another to be exempt from waiting 14 days to exercise their right to buy a firearm for self-defense. That motion was defeated on a party-line vote. The bill now heads to the House Judiciary Committee.

HB101, the semiautomatic rifle and magazine ban bill had a committee substitute filed. They introduced an entirely new bill in place of what was filed before – the new bill has still yet to be made available to the public. From the discussion of the bill, it would allow current owners of magazines that hold more than 10 rounds and semiautomatic rifles to keep their guns and magazines if they register them with the state. New purchases would be banned however. The bill passed on a party-line vote and heads to the House Judiciary Committee as well.

HB164, permitless concealed carry, was tabled on a party-line vote with no substantive debate from those who voted to table the bill.

It was a disappointing day to say the least, but this session isn’t over yet. We are committed to fighting these bills during the session which is our current priority. Once we have clarity on what will and won’t pass, and more importantly the exact language, we will chart our next steps.

HB9 is still pending a vote on the floor of the House. You can use this link to tell your state representative to oppose the bill that could make you criminally liable for someone else’s actions.

Both bills create a crime of “discharging a firearm in a densely populated area” but they lack exemptions for acts of self-defense or shooting at an indoor range. The bills also fail to adequately define what a “densely populated area” is. The bills will be heard in Room 309 starting at 9am (Zoom Link). Bill Soules (D-Las Cruces), legislation that attempts to supersede federal law and make it a FELONY to manufacture, sell, transfer, or acquire a firearm sound suppressor and other National Firearms Act items, as well as certain semi-automatic pistols.

Tuesday, February 7, the New Mexico House Consumer & Public Affairs Committee will hold public hearings on three extreme gun control proposals:

House Bill 50 by Rep. Patricia Roybal Caballero (D-ABQ) makes it a FELONY to transfer or possess any standard capacity magazine capable of holding 10 or more rounds of ammunition. The 9-round limit would be the lowest in the nation and would effectively ban the use of some of the most popular pistols and rifles purchased and owned by law-abiding New Mexicans.

House Bill 100 by Rep. Andrea Romero (D-Santa Fe) expands New Mexico’s so-called “universal background check” law to include a mandatory 14-day waiting period on all firearm purchases. This criminal protection bill would delay your ability to exercise your Second Amendment right to defend yourself, your family and your property.

House Bill 101 by Rep. Andrea Romero (D-Santa Fe) bans the manufacture, possession, purchase, sale or transfer of countless commonly-owned semi-automatic rifles, pistols and shotguns dubbed “assault weapons” under the act and standard capacity magazines capable of holding more than 10 rounds of ammunition. Current owners would be required to move them out of state, sell them to a federal firearm licensed dealer or surrender them to a law enforcement agency prior to July 1, 2023 – or face FELONY charges.

On Friday, February 3rd, two gun bills were heard in committees. SB44, the polling place gun ban, was passed out of Senate Judiciary on a party-line vote. That bill now heads to the Senate Floor. In the House Judiciary Committee, HB72, the proposed ban on bump stocks and binary triggers was held back by the committee so a committee substitute could be made. This means the committee will substantially rewrite the bill and hear the new bill at a future date. We will send an update as soon as we have a copy of the new bill and when it will be heard. Below is the status of the bills we are tracking that have scheduled hearings or pending votes on the floor.

House Floor
HB9 – The firearm owner liability bill where you could be criminally charged for someone else’s actions with your gun. You can use this link to send a pre-drafted letter to your state representative asking them to oppose the bill.

HB100 – This bill would impose a 14 day waiting period to purchase a gun. After filling out the form 4473, you would have to wait two weeks to take the gun home. You can use this link to send a pre-drafted letter to members of the committee.
HB101This bill would make it a felony to possess or purchase a semiautomatic rifle, a magazine that holds more than 10 rounds, or a firearm with a fixed magazine that holds more than 10 rounds. There is no grandfather clause, you would have to turn in your guns and magazines or go to jail. You can use this link to send a pre-drafted letter to members of the committee.
HB164 – This is the one bill on this list we support, it would allow New Mexicans to concealed carry without a permit.
