Department of Game and Fish reminds customers to call or go online for services
SANTA FE – As the holiday season is quickly approaching, the Department of Game and Fish is continuing to proactively take measures to keep staff and customers safe from COVID-19 by keeping offices closed. Department services remain accessible to customers by phone, on the website, Facebook or by appointment when required.
The rates at which COVID positive cases and COVID related deaths in New Mexico continue to rise is alarming. Per Governor Michelle Lujan Grisham’s current executive order, everyone is encouraged to stay home, avoid travel and not attend public gatherings. Officials have predicted that many people may not heed these recommendations during the holidays, causing the Department to take further precautions to keep staff and customers safe from COVID-19. All New Mexico Department of Game and Fish offices, including Albuquerque, Las Cruces, Raton, Roswell and Santa Fe, will be closed to all staff and will remain closed to the public at least through December 4. Other properties, such as the state fish hatcheries, will also remain closed to the public. Visit the Department’s Alert page for information on the closures.
Private land hunters need to be proactive, purchasing licenses online as soon as possible to allow ample time to receive their carcass tag(s). Shipping the paper tag typically takes 14-days. Hunters do have the option to use the NM E-Tag ap if they purchase a license within the 14-day window.

If you need in person help, such as pelt tagging a bear or cougar, appointments must be made in advance. For pelt tagging, please call the Harvest Hotline at (877) 950-5466.

For all other appointments, call the Information Center.
The Department, including the Information Center, will be closed on Nov. 26 and 27 for the Thanksgiving holiday.

Game Commission to meet virtually Oct. 16
SANTA FE – The New Mexico State Game Commission will meet virtually Friday, Oct. 16 at 9:00 a.m.
The full agenda and other information will be available on the Department of Game and Fish website before the meeting.
If you are interested in participating and providing comments, you are encouraged to pre-register to attend the meeting on the Zoom Webinar platform. More information, including how to join the meeting by phone, is available on the Department’s website.
The New Mexico State Game Commission meeting will also be available to view via a live webcast on the Department’s website. Webcast participants can listen to the meeting using a desktop computer or mobile devices such as smartphones and tablets.
The State Game Commission is composed of seven members who represent the state’s diverse interests in wildlife-associated recreation and conservation. Members are appointed by the governor and confirmed by the state Senate. Current members are Chairwoman Sharon Salazar Hickey, Vice-Chairwoman Roberta Salazar-Henry, Jimmy Bates, Gail Cramer, Tirzio Lopez, David Soules and Jeremy Vesbach.

The Albuquerque City Council is back at it, with two anti-gun proposals being heard TOMORROW night. Now is the time to take acton and make our voices heard!
Ordinance O-19-82mandates locked storage requirements for any firearms outside your immediate possession or control, with fines and/or jail time for violations. Requiring all firearms out of arm’s reach to be stored with a lock or in a locked container will render them useless in self-defense situations and most recreational or competitive shooting scenarios. New Mexico already has a child abuse/endangerment statute that gives law enforcement and district attorneys the tools to charge and prosecute parents or guardians in appropriate cases when their child gains unauthorized access to a firearm and commits a crime or injures himself or another. This ordinance is expected to be considered at the Council’s meeting on Monday, September 21, at 3:00 pm.
Ordinance O-19-83 bans firearms at any building owned or leased by the city for conducting business with the public, including city hall, city libraries, city community centers, city parks and recreation facilities. This would negate your right to carry and protect yourself in these taxpayer-owned buildings and facilities and nullify your state-issued concealed handgun license in countless locations. Criminals would ignore these newly-created gun-free zones that leave law-abiding citizens defenseless. This measure is expected to be considered at the Council’s meeting on Monday, September 21, at 3:00 pm.

FEE $5 (includes cook out on Sat and match fees on Sunday and handouts). Additional funding is provided by the Rocky Elk Foundation, Civilian Marksmanship Program, and Socorro Gun Club.
All students will receive expert instruction and coaching in the fundamental principles and techniques of prone and 3- position .22 rifle shooting (i.e., prone, standing, kneeling), which will carry over to air rifle and highpower rifle shooting. Prone only shooters are encouraged to attend. Students will be provided a safe learning environment that will enhance their shooting skills and prepare them for competition. Both James and Virginia McLemore are certified NRA instructors. Virginia is a certified coach, training counselor, national champion, and holds national records in highpower and smallbore rifle. Students must be at least 10 years old. ADULTS ARE WELCOMED. .22 rifles and other equipment will be provided if requested before Thursday September 10 and subjected to availability. If you have your own please bring it. On Sunday there will be a smallbore rifle competition open to all, even if you do not attend Saturday’s classes (see below).

COMPETITION SUNDAY, September 13, 2020 (Open to all even if they did not attend the clinic). Time 8:30.
The course of fire will consist of: 20 shots each position (kneeling, prone, standing, target A-25), Dewar course (20 shots, 50 yds, target A23-5; 20 shots 100 yds, target A-25. Any .22 rifle, any sights. If shooters want to shoot prone only course of fire is 60 shots prone, 50 yds, target A-25, plus the Dewar course. Coaching is allowed in this competition only.
NRA classification will be used (rule 19.15). Competitors will be grouped by age: novice (10 or younger), subjunior (11-14), inter. junior (14-17), junior (18-20), and adult (over 21). Less than 3 competitors will be combined.

Between presumptive Democratic presidential nominee Joe Biden’s calls for firearm confiscation and the draft Democratic Party Platform, the 2020 Democratic ticket was already shaping up to be the most anti-Second Amendment in history. With Biden’s, or his team of able-minded handlers’, choice of Sen. Kamala Harris (D-Calif.) for the vice presidential slot, the Biden campaign and the Democratic Party have cemented this ignominious distinction.
Biden’s advanced age and visible decline make this vice presidential decision even more concerning. A Harris presidency would be an existential threat to the Second Amendment and gun owners.
Harris Does Not Believe the Second Amendment Protects an Individual Right to Keep and Bear Arms
As District Attorney of San Francisco, Harris signed on to an amicus curiae brief in the U.S. Supreme Court case District of Columbia v. Heller that argued the Second Amendment does not protect an individual right to keep and bear arms. The Heller case concerned a complete prohibition on the civilian ownership of handguns within the District of Columbia.
Advocating against the individual right to keep and bear arms, the brief argued,
courts have consistently sustained criminal firearms laws against Second Amendment challenges by holding that, inter alia, (i) the Second Amendment provides only a militia-related right to bear arms, (ii) the Second Amendment does not apply to legislation passed by state or local governments,
According to the document, the Second Amendment does not protect an individual right, but rather, the lower court in Heller“create[d]”this right. The brief stated,
The lower court’s decision, however, creates a broad private right to possess any firearm that is a “lineal descendant” of a founding era weapon and that is in “common use” with a “military application” today.
Anticipating the U.S. Supreme Court’s move in the next landmark Second Amendment case (McDonald v. Chicago), Harris’s brief reiterated that the Second Amendment right to keep and bear arms should not be incorporated to the states. Had this thinking been adopted, state and local governments would be empowered to curtail or even extinguish gun rights without restraint. State and local governments would have been able to bar their residents from owning any firearms whatsoever.
Harris’s extreme views on the U.S. Constitution were again born out in her votes against President Donald Trump’s pro-Second Amendment nominees for the U.S. Supreme Court. On September 4, 2018, Harris delivered a speech to the Senate where she cited Justice Brett Kavanaugh’s fidelity to the correct interpretation of the Second Amendment as a reason for her opposition to his confirmation.
With this track record, gun owners could expect a president Harris to nominate U.S. Supreme Court justices and lower court judges that share her discredited view of the Second Amendment.
Harris Intends to Ban and Confiscate Commonly-Owned Firearms
Harris has repeatedly supported a ban on commonly-owned semi-automatic firearms.
Harris is a co-sponsor of Sen. Dianne Feinstein’s (D-Calif.) Assault Weapons Ban of 2019 (S.66). During the previous Congress, Biden’s VP pick supported Feinstein’s Assault Weapons Ban of 2017 (S.2095) Sold as a reinstatement of the failed 1994 Clinton semi-auto ban, S.66 is in fact a far more sweeping attack on Second Amendment rights.
The bill would ban the importation, sale, manufacture, transfer, and possession of commonly-owned semi-automatic firearms like America’s most popular rifle, the AR-15. The 1994 ban prohibited firearms capable of accepting a detachable magazine that were equipped with two items from a list of enumerated features –such as a collapsible stock, pistol grip, or threaded barrel. S.66 would prohibit firearms capable of accepting a detachable magazine that have only one of the offending features. Moreover, the list of features has been expanded to target a wider array of firearms.
The bill would also ban the importation, sale, manufacture, transfer, and possession of magazines capable of holding more than 10 rounds of ammunition. This measure would prohibit the standard magazines of the most popular handguns in the country.
However, Harris has made clear that Feinstein’s broad attack on the Second Amendment does not go far enough for her liking. S.66 would grandfather firearms and magazines currently possessed by American gun owners. Harris wants gun confiscation.
At a campaign even in Londonderry, N.H. in early September, then-presidential candidate Harris told reporters that confiscation of commonly-owned semi-automatic firearms was “a good idea.”Elaborating on her support for a compulsory “buyback”program, the senator added, “We have to work out the details — there are a lot of details — but I do…We have to take those guns off the streets.”
On the September 16 edition of the “The Tonight Show Starring Jimmy Fallon,”Harris reiterated her support for gun confiscation. During a question and answer session, an audience member asked Harris “Do you believe in the mandatory buyback of quote-unquote assault weapons and whether or not you do, how does that idea not go against fundamentally the Second Amendment?”
The candidate responded “I do believe that we need to do buybacks.”Making clear that she believes Americans’Second Amendment are for sale, the senator added “A buyback program is a good idea. Now we need to do it the right way. And part of that has to be, you know, buy back and give people their value, the financial value.”
Further demonstrating Harris’s commitment to gun confiscation, the candidate called for a “mandatory buyback program”during an October 3 MSNBC gun control forum and again during a November interview with NBC Nightly News.
Harris Would Abuse Executive Power to Illegally Attack Gun Rights
In their eagerness to burden gun owners, the Barack Obama administration stretched existing federal law to its limits. In late 2015, White House Deputy Press Secretary Eric Shultz told reporters that Obama “has asked his team to scrub existing legal authorities to see if there’s any additional action we can take administratively,”adding, “The president has made clear he’s not satisfied with where we are, and expects that work to be completed soon.”Put another way, the Obama administration exhausted the legislative branch’s authority to unilaterally control guns.
Harris has proposed to use executive power to enact gun control in a manner that even the Obama administration understood was illegal.
If Congress fails to send comprehensive gun safety legislation to Harris’ desk within her first 100 days as president – including universal background checks, an assault weapons ban, and the repeal of the NRA’s corporate gun manufacturer and dealer immunity bill – she will take executive action to keep our kids and communities safe
In other words, if congress refuses to legislate in the manner she demands, Harris would break the law to legislate by decree.
Among her proposed executive actions would be a cap on the number of firearms an individual could privately transact in a year.
Present statute, 18 U.S.C. §922, requires that an individual “engaged in the business”of selling firearms register as a Federal Firearms Licensee and perform a background check prior to transferring a firearm to an unlicensed individual. “Engaged in the business”is further defined in 18 U.S.C. §921 to mean,
a person who devotes time, attention, and labor to dealing in firearms as a regular course of trade or business with the principal objective of livelihood and profit through the repetitive purchase and resale of firearms, but such term shall not include a person who makes occasional sales, exchanges, or purchases of firearms for the enhancement of a personal collection or for a hobby, or who sells all or part of his personal collection of firearms;
This language was explicitly adopted to avoid a numerical cap on the number of firearms an individual could privately transfer, instead focusing on whether the person was engaged in the activity “with the principal objective of livelihood and profit.”Harris’s proposed executive action would violate the clear language of 18 U.S.C. §921.
The Obama administration explored this avenue of gun control and determined it was outside their authority. Rejecting a hard cap as untenable, the Obama administration opted to release a guidance document elaborating upon the circumstances under which a person must obtain a Federal Firearms License.
Harris has also made clear that she intends to abuse ATF’s firearm manufacturer and dealer licensing function to circumvent the Protection of Lawful Commerce in Arms Act and attack the gun industry. Other proposed executive actions include an illegal expansion of the prohibited persons categories and further restrictions on the importation of firearms.
With her rejection of the Second Amendment, advocacy for gun confiscation, and intent to ignore existing firearms law, Harris is a singular and despotic danger to gun owners. Devoid of any respect for the U.S. Constitution, the legislative process, and the rule of law, Harris has proven herself unfit for office.
President Trump signed the Great American Outdoors Act into law, which will help improve public lands and stabilize funding for the Land and Water Conservation Fund.
Money for myriad projects, agencies and the Land and Water Conservation Fund has been approved thanks to President Trump’s signing of the Great American Outdoors Act into law.
It provides full and permanent funding of $900 million per year for the Land and Water Conservation Fund, a 55-year-old fund that repeatedly has been pillaged for non-conservation projects. The law ensures all funding is directed to its intended purpose of state and federal conservation projects. It also provides $9.5 billion over five years for federal land management agencies to tackle deferred maintenance backlogs.
Plaudits rolled in from organizations after the official signing ceremony.
“The Boone and Crockett Club’s founder, Theodore Roosevelt, would be proud of this commitment to invest in the management of the public lands legacy that he created,” said Boone and Crockett Club President Tim Brady. “The Great American Outdoors Act brought together both parties because conservation is one of the few issues that everyone in this great country can get behind. Whether you hunt, fish, camp, hike, backpack, walk, paddle or just like to take your child to the neighborhood park, this new law will benefit all Americans.”
“We also appreciate the hard work of Senators Cory Gardner, Steve Daines, and Joe Manchin for working with Senate Majority Leader Mitch McConnell to lead this bill through the Senate, along with Representatives Joe Cunningham (D-SC) and Mike Simpson (R-ID) who worked with House Speaker Nancy Pelosi (D-CA), Majority Leader Steny Hoyer (D-MD) and Republican Leader Kevin McCarthy (R-CA) to lead the bill through the House. Enacting this legislation will rank among the most historic conservation actions in decades, and the sportsmen-conservation community can take pride in our work to ensure that this bill became law.”
Public Land Infrastructure
The Congressional Sportsmen’s Foundation led a successful effort to secure the inclusion of $3 billion to repair and maintain public land infrastructure overseen by the Bureau of Land Management (BLM), U.S. Fish and Wildlife Service (USFWS), and U.S. Forest Service (USFS), agencies that provide critically important recreational opportunities for America’s sportsmen and women.
“We have been working on this effort for many years, and we are thrilled that the Great American Outdoors Act is now permanent federal law with the President’s signature. This is a once-in-a-lifetime victory for sportsmen and women,” said CSF President Jeff Crane. “Now, we will finally realize the benefits of increased conservation funding, increased access for hunters and anglers, more support for public lands and waters, and a boost in the sporting-conservation economy. CSF extends our sincere thanks to the House and Senate Congressional Sportsmen’s Caucus members who championed and voted to support these priorities.”
The inclusion of funding specifically for BLM, USFWS, and USFS lands and waters will ensure that Americans have the ability to access critically important hunting, fishing, and recreational shooting opportunities. More than 246 million acres, or 99%, of BLM lands are open to hunting and fishing while the USFS reports that 99% of the 193 million acres it administers are open to hunting and at least 99% of USFS administered rivers, streams, and lakes are open to fishing.
Collectively, BLM, USFWS, and USFS annually support more than 25 million hunting days and nearly 45 million fishing days, highlighting the importance of these lands for America’s sportsmen and women as well as the outdoor economy. Additionally, funding to address these agencies’ maintenance backlog will create more than 100,000 employment opportunities.
The Great American Outdoors Act also ensures $15 million annually is dedicated to increase public access for hunting, fishing, recreational shooting, and other forms of outdoor recreation.
Restoration Fund
This legislation will create a National Parks and Public Land Legacy Restoration Fund to address the growing maintenance backlog on federal public lands.
Half the revenue from energy development on public lands would be allocated to the fund and distributed to the National Park Service, the U.S. Forest Service, the U.S. Fish and Wildlife Service, the Bureau of Land Management and the Bureau of Indian Education to cover overdue maintenance costs.
“The truly bipartisan nature of this bill is commendable, and the President’s signature today puts the finishing touches on what will go down as one of the great conservation achievements of our lifetime,” said Ducks Unlimited CEO Adam Putnam. “Now that it’s the law of the land, we look forward to working with our partners at federal and state agencies, and in the conservation community, to help deliver this law’s ambitious promises to improve the American landscape for generations to come.”
These new investments will boost America’s outdoor recreation industry, which generates $887 billion annually and supports 7.6 million American jobs.
