NMSSA Legislative Update – The 2023 Session is Over

New Mexico Shooting Sports Association - NRA Sanctioned Organization

At noon today, the 2023 New Mexico Legislative Session came to a close. Only one bill, HB9, passed. See below for more details on that bill. All the other anti-gun bills we were fighting against died. That list includes proposed bans on magazines and guns, waiting periods, age restrictions, FFL and gun manufacturer civil liability, and the polling place gun ban. Thank you to everyone who spoke out against these bills. There were a number of Republican, and some Democrat, legislators who fought hard for our rights in Santa Fe and we thank them.

We are now preparing for the possibility of a special session focused on anti-gun legislation. NMSSA has already begun to prepare for such a session. If there is one, it is likely to be short, as special sessions have been in the past. To maximize our voice during a potential special session on gun bills, we will be holding a rally in Santa Fe during the special session if the governor calls one. Please continue to watch for our alerts for news of a possible special session.

HB9: This bill is the one that passed and was signed by the governor. This bill will charge a gun owner with a misdemeanor if a third-party minor uses their firearm to threaten or injure someone. There is a felony charge for the gun owner if a third-party minor uses their firearm to kill someone. The bill, in its final version, does not specify how a firearm must be stored, but instead allows for the method of storage be used as a defense for a gun owner charged with a crime under the bill.

NMSSA Legislative Update 3/16/23

We have less than two days left in this year’s legislative session. Today, SB428 was passed out of the House Judiciary Committee, but it was amended. The amendments were not good ones, but they force the bill to travel back to the senate for concurrence if it passes the house side. That was the only action to report on as of the writing of this email – but they are meeting late into the night now. Below is the list of bills we are watching as the clock quickly winds down in Santa Fe.

HB9: This bill is the one that passed and has been signed by the governor so far. This bill will charge a gun owner with a misdemeanor if a third-party minor uses their firearm to threaten or injure someone. There is a felony charge for the gun owner if a third-party minor uses their firearm to kill someone. The bill, in its final version, does not specify how a firearm must be stored, but instead allows for the method of storage be used as a defense for a gun owner charged with a crime under the bill.

HB100: The house version of a 14-day waiting period is still on the floor of the house waiting for a vote, but the governor is pushing hard to try to move the bill before the session comes to a close. Use this link to tell house members to oppose the bill.

SB44: This bill would ban the open or concealed carry of firearms within 100ft of a polling place. It has been sitting on the house floor for a few days now with no vote taken yet.

SB427: This is the senate version of a 14-day waiting period. It has been sitting on the floor of the senate for several days now with no action taken yet. Use this link to tell members of the senate to oppose the bill.

SB428: This bill would make it easier for the State or New Mexico or anti-gun groups to sue gun manufacturers or retailers in New Mexico. It is now on the house floor waiting for a vote by all members of the house.

We have less than three days left in the 2023 Legislative Session. What happens in the coming hours will determine what legislation passes, or fails to pass. Here are the bills we are tracking as the session comes to a close. If a bill is not listed here, it is not quite dead yet, but faces a narrow, uphill battle to pass.

SB44: This bill would ban the open or concealed carry of firearms within 100ft of a polling place. It has been sitting on the house floor for a few days now with no vote taken yet.

SB428: This bill would make it easier for the State or New Mexico or anti-gun groups to sue gun manufacturers or retailers in New Mexico. It will be in the House Judiciary Committee on 3/16 at 9:00am in Room 309 (Zoom Link).

Here is where we stand with just eight days left to go in this year’s legislative session. If a bill is not listed here, while it isn’t dead yet, its path to passing has significantly narrowed with the clock running down. Nevertheless, we continue to monitor all gun bills and will send updates are needed.

HB9 – In a late-night floor session, the house concurred with the senate’s amendments to the bill. It now heads to the governor’s desk. This bill would charge a gun owner with a misdemeanor if a third-party minor uses their firearm to threaten or injure someone. There is a felony charge for the gun owner if a third-party minor uses their firearm to kill someone. The bill, in its final version, does not specify how a firearm must be stored, but instead allows for the method of storage be used as a defense for a gun owner charged with a crime under the bill.

HB100 – The house version of a 14-day waiting period for firearm sales has been sitting on the Floor of the House for several weeks now with no vote taken. The bill could still be brought up for a vote, so we encourage you to keep up the pressure against the bill. Here is a pre-drafted email opposing the bill.

SB44 – The bill banning the open or concealed carrying of firearms within 100ft of a polling place while voting is taking place passed the House Judiciary Committee and is now waiting for a vote by the full house.

SB427 – This is the senate version of a 14-day waiting period. It is different from the house version in a few regards. It would impose criminal penalties on a FFL who didn’t hold the firearm for at least 14 days. It exempts someone who has a valid concealed carry permit from having to wait 14 days, they would be able to take the firearm home once they purchased it. Interestingly, in its current form, it actually exempts concealed carry permit holders from having to do a background check if they are purchasing a gun in a private firearm sale in New Mexico, undoing part of the private firearm sales background check law that passed a few years ago. The bill is now waiting a vote by the full senate.

SB428 – This bill was quickly rammed through the Senate Judiciary Committee this week with almost no time given to opponents to testify against the bill. It would make it easier to sue gun manufacturers and retailers who do business in New Mexico. Several FFLs have testified they may not be able to obtain insurance in New Mexico if the bill passes. The bill is now waiting a vote by the full senate.

There are now just ten days left in the 2023 legislative session. On the house side, HB9, the bill that would impose criminal penalties on a gun owner if a third-party minor uses their gun to commit a crime or injure someone, wasn’t voted on by the floor today. We expect it to be heard soon, so help us keep up the pressure against it.

SB44, the bill that would ban the carrying of open and concealed firearms with 100ft of a polling place while voting is taking place, was passed on party lines out of the House Judiciary Committee. That bill is now headed to the House Floor for a vote by all members of the house.

In the Senate Judiciary Committee, SB427, the senate version of a 14-day waiting period for gun purchases, was passed on a party-line vote of the senators present. It now heads to the Senate Floor. SB428, the bill to make it easier to sue gun manufacturers and retailers in New Mexico, was heard in committee, but not voted on. That bill stays in the Senate Judiciary Committee where we expect it to be voted on in their Friday meeting.

The next ten days are critical. No anti-Second Amendment bills have passed yet, but the governor is pushing hard for her anti-gun and anti-freedom agenda. It has been a long session, but we have to keep doing everything we can until sine die.

We now have less than two weeks to go in the 2023 New Mexico Legislative Session. We found out today that HB101 will be not heard in the House Judiciary Committee on Monday, but it could be heard later in the week, so be on the lookout for our alerts. The bill would ban the sale of semiautomatic rifles in New Mexico and require current owners to register them with the state.

HB100, the house version of a 14-day waiting period for firearm sales, still hasn’t been heard on the House Floor yet. This means we have to keep up the pressure against the bill. You can use this link to send a pre-drafted email to your state representative asking them to oppose the bill.

Today in the Senate Health and Public Affairs Committee, both SB427 and SB428 were passed on party-line votes of the senators present. SB427 is another version of a 14-day waiting period. SB428, while amended today to try to make it fall in line with the Federal Protection of Lawful Commerce in Arms Act, would still target gun manufacturers and retailers with lawsuits over the criminal acts of third-parties. We remain firmly opposed to the bill. The next stop for both bills is the Senate Judiciary Committee.

Wd don’t have final confirmation yet, but it appears likely that HB101 will be heard in the House Judiciary Committee sometime next week, quite possibly Monday. The bill would ban the sale of semiautomatic rifles in New Mexico and require current owners to register them with the state. This afternoon, the Senate Floor schedule was shifted around to put HB9, the bill that would impose criminal penalties on a gun owner if a third-party minor used their gun to commit a crime or hurt someone, at the top of the agenda. Senator Neville was able to win one good amendment on the bill, creating greater protections for gun owners involved youth hunting or youth shooting sports, but it remains a bill we are opposed to. Ultimately, it passed the Senate by a vote of 24-16 with one Democrat joining all Republicans opposing the bill. Since the bill was amended, it heads back to the Floor of the House for a concurrence vote.

On Sunday the 5th, both SB427 and SB428 will be heard in the Senate Health and Public Affairs Committee in room 311 at 1:30pm (Zoom Link). SB427 is another version of a 14-day waiting period for firearm sales. Here is a pre-drafted email opposing SB427. SB428 is an attempt at circumventing federal law to allow lawsuits against gun manufacturers and FFLs for the criminal acts of third-parties. Here is a pre-drafted email opposing SB428.

Today’s legislative action got off to a wild start when the governor threatened to hold a special session to focus on gun control if the legislature doesn’t pass her priority bills. Her threat was noted in the Senate Finance Committee where HB9, the bill that would impose criminal penalties on a gun owner if a third-party minor uses their gun to commit a crime or injure someone, was scheduled to be heard this morning. Senate Finance rolled the bill over in their morning meeting, but did end up hearing HB9 this afternoon where it passed on party-lines. The bill now heads to the floor of the senate for a vote by the full senate.

In the Senate Judiciary Committee, SB116 was heard after sitting dormant in the committee for weeks. The bill would ban the purchase and possession of semiautomatic firearms by anyone under the age of 21. After some lively debate, a motion to table the bill failed on a bipartisan vote of 4-4. Then, a motion to pass the bill also failed on a bipartisan 4-4 vote. This means the bill stays in Senate Judiciary for now, but can be brought back again. Not all committee members were present at the meeting.

The governor pushed hard to have HB100, the proposed 14-day waiting period for gun purchases, heard on the floor of the house today. But thanks to the pushback against the bill from New Mexicans from across the state, the bill wasn’t called up for a vote today. HB101, the ban on the sale of semiautomatic rifles and registration of currently owned ones, is still waiting to be brought up again in the House Judiciary Committee. We know that the governor is pushing very hard behind the scenes for both of these bills, so we are watching them closely right now.
