There will be a resolution proposed on Thursday February 21st at the Sandoval County Commission Chambers at 6pm for Sandoval County to become a sanctuary county.\u00a0 The address for those who can attend is 1500 Idalia Rd. Rio Rancho, NM-Building D.\u00a0 Please email or call your respective commissioner to politely express your support of the resolution.\u00a0 The resolution can be found on their website at

The resolution that is being proposed is for 2nd Amendment Sanctuary status for Sandoval County.\u00a0 The “sanctuary” wording is misleading to some members so here is the actual resolution.
\nSANDOVAL COUNTY\u00a0Resolution No. 2-21-19.9<\/p>\n

IN\u00a0SUPPORT OF THE\u00a0SECOND\u00a0AMENDMENT OF THE\u00a0US CONSTITUTION AND
\nDECLARING\u00a0SANDOVAL\u00a0COUNTY TO BE A
\nSECOND\u00a0AMENDMENT\u00a0SANCTUARY\u00a0COUNTY<\/p>\n

WHEREAS, the Board of County Commissioners met in a regular duly noticed meeting onFebruary 12, 2019 at 9:00 a.m. in the Sandoval County 1500 Idalia Road, Building D., Bernalillo, New Mexico; and,<\/p>\n

WHEREAS, NMSA 1978, Section\u00a04-37-1 (1995) provides that Counties have the power to,\u201cprovide for the safety, preserve the health, promote the prosperity and improve the morals, order, comfort and convenience of any county or its inhabitants\u201d; and,<\/p>\n

WHEREAS, NMSA, 1978, Section\u00a04-38-18 (1976) provides that a Board of County\u00a0Commissioner has the duty and authority \u201c[t]o represent the county and have the care of the county property and the management of the interest of the county in all cases where no other provision is made by law; and,<\/p>\n

WHEREAS, the Second Amendment to the United States Constitution, adopted in 1791 as part of the Bill of Rights, protects the inalienable and individual right of the people to keep and bear arms; and,<\/p>\n

WHEREAS, the Supreme Court in the District of Columbia v. Heller, decision affirmed<\/p>\n

; and,<\/p>\n

WHEREAS, the Supreme Court in<\/p>\n

WHEREAS, the Supreme Court, in United States v. Miller, 307 U.S. 174 (1939), opined that firearms that are part of ordinary military equipment, or with use that could contribute to the common defense are protected by the Second Amendment; and,<\/p>\n

WHEREAS, it is the desire of the Board to declare its support of the Second Amendment to the United States Constitution and the New Mexico Constitution protecting citizens\u2019 inalienable andindividual right to keep and bear arms; and, 554 U.S. 570 (200)\u00a0 an individual’s\u00a0right\u00a0to possess\u00a0firearms, unconnected with service in a militia, for traditionally lawful purposes, such as self-defense within the home. McDonald v. Chicago, 561 U.S. 742 (2010), affirmed that the right of an individual to “keep and bear arms,” as protected under the\u00a0Second Amendment,<\/p>\n

is\u00a0incorporated\u00a0by the\u00a0Due Process Clause of the Fourteenth Amendment\u00a0against the\u00a0states; and,WHEREAS,\u00a0Article II, Section 6 of the Constitution of New Mexico provides that \u201c[n]o\u00a0law shall abridge the right of the citizen to keep and bear arms for security and defense, for lawful hunting and recreational use and for other lawful purposes, but nothing herein shall be held to permit the carrying of concealed weapons. No municipality or county shall regulate, in any way, an incident of the right to keep and bear arms;\u201d and,<\/p>\n

WHEREAS, the members of this Board took an oath to support and defend the United States Constitution, the Constitution of the State of New Mexico and the laws of the State of New Mexico (insofar as they are constitutional); and,<\/p>\n

NOW, THEREFORE, BE IT RESOLVED\u00a0by the Board of County Commissioners of the County of Sandoval by the authority granted the Board by the laws of the State of New Mexico and people of Sandoval County, New Mexico to stand and defend their rights and liberties, which are guaranteed by the United States and New Mexico Constitutions, we hereby declare this Resolution as follows:<\/p>\n

Second Amendment Preservation Resolution Designating Sandoval County a\u00a0Second Amendment \u201cSanctuary County\u201d<\/p>\n\n\n\n\n\n
BE IT FURTHER RESOLVED\u00a0that this Board affirms its support for the duly elected Sheriff of Sandoval County, New Mexico in the exercise of his sound discretion and affirms its resolve to support decisions by our Sheriff to not enforce any unconstitutional firearms law against<\/td>\n<\/tr>\n
any citizen.<\/td>\n<\/tr>\n
BE IT FURTHER RESOLVED\u00a0that this Board will not authorize or appropriate government funds, resources, employees, agencies, contractors, buildings, detention centers or offices for the purpose of enforcing law that unconstitutionally infringes on the right of the people to keep and bear arms.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
